How Do Catering Enterprises Register Trademarks?

1. trademark of catering service:

The forty-third category provides food and beverage services, temporary accommodation.

The twenty-ninth category is meat and vegetable products.

The ways and steps of trademark registration:

1. Prepare application documents and submit applications.

1. the applicant's official seal (legal person or other organization organization) or the application for trademark registration (signed by a natural person) shall be affixed, and the commodity category and the name of the trade mark shall be filled out according to the prescribed commodity classification form, which requires typing or printing, not written form.

2. 5 black and white sheets of the trade mark, requiring clear drawings, specifications of long and wide, not less than 5 centimeters and 10 centimeters. If specified colors, 5 colors and 5 black and white ones.

3. directly to the trademark hall, a legal person or other organization shall submit a copy of the business license and produce the original copy; the natural person shall submit a copy of his identity card and produce the original; if he entrusts with the trademark agency, he shall submit a valid copy of the letter of attorney for the trademark and the applicant's qualification.

If a registered trademark is a portrait of a personage, a declaration document should be attached to the trademark registration as a notarized portrait holder.

The application for trademark and the materials provided shall be true, accurate and complete.

4. payment of trademark registration fees: within a category of 10 commodity names or service items, the registration fee for each trademark registration application is 1000 yuan, 10 or more (excluding 10), each additional item, plus 100 yuan.

Where a trademark agency is entrusted, the applicant shall pay the trademark registration fee and agency fee to the trademark agency.

Two. Review and approval

1. the Trademark Office shall issue an acceptance notice to the applicant within 15 days of receipt of the application. The Trademark Office shall preliminarily examine and approve the trademark which is in conformity with the provisions (the period of review is about 12 months) and announce it. If it considers that the content of the application can be amended, it shall issue the "examination opinion" or "rejection of the submission".

2. within three months from the date of the announcement, any person may lodge an objection within three months.

If there is no objection in the announcement period, it shall be approved for registration, issue a trademark registration certificate and make a public announcement.

3. the validity period of a registered trademark is ten years. From the date of approval, the registered trademark shall continue to be used at the expiry of the registered trademark. It shall apply for extension of registration within six months before the expiration of the registration period. During the period, the application for a registered trademark can be extended to six months, if no application has been made, and the registered trademark shall be cancelled.

The validity of each successive exhibition registration is ten years, and it will be announced after the registration is approved.

Note: the application period for general trademark registration is 15 days, the period of review is about 12~15 months, and the announcement period is 3 months. It takes about a year and a half to two years from application to registration.
