Illinois Lead Poisoning Prevention Act (L)

Since January 1, 2010, the total lead content has been prohibited from selling, supplying or pferring any part of the product to children whose total weight is greater than 0.004% (40ppm) but less than 0.06% (600ppm) or the lower limit of lead content set by the federal and state laws and regulations (see Notes). Except for the product with a warning statement, the lead content of at least one component of the product exceeds the standard.


A warning statement should contain at least the following:


Warning: lead.


If swallowing or chewing may be hazardous to health.


Lead dust may be generated.

Placed in the prominent position of the product or package, such as the main display panel, makes it easy for consumers to view the merchandise in the purchase; it can not be blocked by other printed contents; it is legible and easy to read; and contrasts with other printed contents in typography, format and color.


The warning statement must comply with the requirements of the Federal Hazardous Substances Act 16 CFR 1500.121.


Exemption:


LPPA does not apply to components that are not accessible to children in consumer electronics, including personal computers, audio-visual equipment, calculators, cordless telephones, game machines, video screen handheld devices for access to interactive software and related peripherals.


Remarks:


"Painted toys" -

Design

Or painted toys that are intended for children under 12 years of age to play.


"Children's jewelry" - jewelry products for children under 12 years of age and sales targets for children of that age group.


"Child care products" - a product designed or intended to assist children under 6 years of age to sleep, relax or feed, or to promote their sucking or teething.


The stricter limit of lead content in the US Consumer Product Safety Improvement Act came into effect on August 14, 2009.


According to the 2008 Consumer Product Safety Improvement Act (public code No. 110-314), which began in August last year, children's products need to meet a more stringent lead content requirement.

From August 14, 2009 onwards, the total lead content limits for substrates and surface coatings decreased from 0.06% (600ppm) to 0.03% (300ppm) and 0.009% (90ppm) respectively.


The above regulations also have an impact on LPPA, that is, the corresponding lead content in the warning statement is reduced to 0.004-0.009% (40-90ppm) and 0.004-0.03% (40-300ppm).
